DECLARATION OF BOATING ACTIVITY EXEMPTION
Parks Victoria as the declared waterway manager for the Yarra River upstream of port waters of the Port of Melbourne, makes the following declaration under section 203(3) of the Marine Safety Act 2010 (Vic).
For the purposes of boating activity conducted by the Boating Industry Association Victoria, persons and vessels involved in the ‘Surf the Yarra’ wake surfing exhibition on the Yarra River on 5 June 2019, are exempt from the following requirements:
State Rules made under the Marine Act 1988
Item 1. Clause 2(a) – must not exceed 5 knots within 50 metres of a person in the water – applies to participating vessels and rescue vessels;
Item 2. Clause 2(c) – must not exceed 5 knots within 50 metres of another vessel – applies to participating vessels and rescue vessels;
Item 3. Clause 3(a) – must not exceed 5 knots within 50 metres of the waters’ edge – applies to participating vessels and rescue vessels;
Item 4. Clause 3(b) – must not exceed 5 knots within 50 metres of a fixed or floating structure – applies to participating vessels and rescue vessels;
Item 5. Clause 14 – direction of travel on inland waters – applies to participating vessels.
Waterway Rules made under the Marine Safety Act 2010 / Marine Act 1988
Item 6. Clause 3.1 of Schedule 3 – 5 knot speed restriction zone on the Yarra River upstream of port waters of the Port of Melbourne – applies to participating vessels and rescue vessels;
Item 7. Clause 3.3(a) of Schedule 3 – prohibition of swimmers on the Yarra River upstream of the port waters of the Port of Melbourne – applies to participating wake surfers.
Subject to the conditions detailed below:
• • Masters of participating vessels are only exempt from items 1 to 6 for the duration of the event.
• • Masters of rescue vessels are only exempt from items 1 to 4 and item 6 when undertaking a rescue operation to retrieve persons in distress, provide for their initial medical or other needs and deliver them to a place of safety on shore.
• • Participating wake surfers are exempt from item 7 during the event only.
• • All participants involved with the event must wear a personal floatation device at all times during the event.
• • Should vessels or persons not involved in the event enter the exclusion zone, the event must be stopped until the unauthorised vessel or person has moved outside of the zone.
• • The above exemptions apply for the duration of the event from 11:00am to 11:45am on Wednesday 5 June 2019 to the persons and vessels participating in the Boating Industry Association Victoria’s ‘Surf the Yarra’ wake surfing exhibition on the Yarra River, within the exclusion zone waters between Seafarers Bridge and Spencer St Bridge, adjacent to the Melbourne Convention and Exhibition Centre, provided the stated safety controls and undertakings detailed in the application form and associated documentation are adhered to.

NOTICE OF BOATING ACTIVITY EXCLUSION ZONE
Parks Victoria as the declared waterway manager for the Yarra River upstream of port waters of the Port of Melbourne, hereby gives notice under section 208(2) of the Marine Safety Act 2010 (Vic) that all persons and vessels not registered to take part in the ‘Surf the Yarra’ wake surfing exhibition on the Yarra River, are prohibited from entering and remaining in the waters of the Yarra River between Seafarers Bridge and Spencer St Bridge, adjacent to the Melbourne Convention and Exhibition Centre.
The exclusion zone will be in effect from 11:00am to 11:45am on Wednesday 5 June 2019.
